1. Acceptance and confirmation of the agreement

1.1. Before using the climbing facility, each user must take note of this user agreement.

1.2. By signing, the user confirms that he has read and understood it. The climbing facility can only be entered and used if this user agreement has been accepted and implemented unreservedly.

1.3. For minors, the custodian must read the terms of use and discuss these with the minor user in full. The custodian must sign this user agreement for the minor user.

 

2. Rights of use

2.1. Employees of GK Software SE are entitled to use the facility after having signed the user agreement and having successfully completed an induction to the climbing facility of GK Software SE.

2.2. Third parties also have the right of use only if GK Software SE approves, the user agreement has been signed by the third party and an induction to the climbing facility has been performed by GK Software SE. The date and time of use, as well as the number and names of the users, must be indicated in the registration email.

2.3. For safety reasons the use of the climbing facility is not permitted in the following cases:

a) for persons below a minimum size of 110 cm and below a minimum age of 6 years,

b) for persons whose body weight exceeds 130 kg or if it is not possible to securely fit the safety equipment due to certain waist / hip measurements,

c) for persons suffering from a physical or psychological impairment which could pose a risk to their own health or to other users during the use of the climbing facility,

d) for persons who are under the influence of alcohol or drugs or who have taken medications which affects their perception,

e) for pregnant persons; use of the climbing system up to the third month is admitted at own risk however.

2.4. Before using the climbing facility, a medical examination of physical fitness is recommended.

 

3. Introduction to safety techniques and climbing facilities

3.1. Prior to using the climbing facility, each user must participate in a theoretical and practical induction (induction to safety techniques).

3.2. An induction to safety techniques may only be given by individuals appointed by the board of directors of GK Software SE.

3.3. The autonomous use of the facility is only permitted after a successful induction to the climbing facility and proof of proficiency of correct knots as well as all appropriate safety techniques.

3.4. Presentation of the DAV climbing certificate (for toprope, lead climbing) is considered proof of the mastery of the correct knots as well as the corresponding belay techniques.

 

4. Time of use / refusal of access

4.1. The climbing facility of GK Software SE may only be used from Monday to Friday from 8 AM to 8 PM.

4.2. The climbing facility of GK Software SE may only be used on Saturdays and Sundays after prior registration. Registration must be made via This email address is being protected from spambots. You need JavaScript enabled to view it.. The date and time of use, as well as the number and names of the users, shall be indicated in the registration. GK Software is entitled to refuse registration. Use of the climbing facility on weekends requires the presence of at least three users. On weekends, minors must always be accompanied and supervised by a person who has custody of the child or an adult guardian who is also entitled to use the climbing facility in accordance with this user agreement. GK Software SE explicitly points out that no staff may be present on weekends. Use on weekends is at one’s own risk.

4.3. In the event of a thunderstorm / lightning hazard, the climbing facility must be exited or rather may not be entered / used. This also applies to precipitation (rain, snow, etc.) and outside temperatures below 0 ° C and above 30 ° C. Twilight / dawn must be observed; the use of the climbing system is only permitted in daylight.

 

5. Use of the climbing facility by minors

5.1. Children up to completion of the age of 14 are allowed to use the climbing facility only under the supervision and direct guidance of an adult custodian or guardian who himself is allowed to use the climbing facility. Particularly for children up to completion of the age of 14, there are specific risks regarding the use of and stay in the climbing facility, in respect of which the custodian or guardian has to take provisions at their own authority. Custodians or guardians shall, in particular, ensure that the equipment and elements of the climbing facility are used in the correct manner, that the safety instructions and belay techniques are adhered to and that assistance (also verbal) is possible at any time.

5.2. Young people from the age of 14 may also use the climbing facility of GK Software SE without supervision of a custodian or guardian if the custodian has provided a written consent form to GK Software SE.

5.3. The following applies in case of use by school classes (or similar): The custodians must agree to the company of an accountable supervisor. This supervisor must also complete the "Consent Form Teacher / Group Leader".

5.4. The use of the climbing facility under the supervision of a supervisor in accordance with the aforementioned regulations (section 5.1 and section 5.3) requires the submission of a corresponding power of attorney by the custodians. The supervisor must be entitled to use the climbing facility himself.

 

6. Equipment, valuables, equipment rental

6.1. The user may use his own equipment. This equipment must include:

  • Helmet: EN 12492 (recommended)
  • Carabiner: CE 0321
  • Fuse: EN 15151-2UIAA
  • Self-locking loop: CE 0123 / EN 355:2002 or
  • Band sling: CE 0123 EN 566
  • Express set: CE 1019 EN 566 for sling and EN 12275:2013 for carabiners

The equipment must comply with the current CE standard (see above) and be in full working condition.

6.2. The user must take care of personal belongings / valuables and protect them from loss or damage.

6.3. Users can borrow the equipment - subject to availability - at GK Software SE free of charge. Borrowing equipment is subject to prior booking at GK Software SE via email to This email address is being protected from spambots. You need JavaScript enabled to view it.. Equipment can only be borrowed after confirmation by GK Software SE. GK Software SE retains ownership of the items on loan. The user may use the equipment on loan only at the climbing facility of GK Software SE and according to the rules of the safety instructions; any other use is not permitted. Borrowed equipment must be treated with special care. It is the responsibility of the user to check the borrowed equipment before use. The user shall immediately notify GK Software SE of defects / damage, abnormalities as well as the destruction or loss of the borrowed equipment. Return location and time are agreed when handing over the equipment.

 

7. Individual responsibility / User rules

7.1. Individual responsibility

7.1.1. It is expressly pointed out that bouldering (rope-free climbing up to a maximum of 4.50 meters of grip height with a corresponding fall protection mat as underground) and climbing bears risks and the use of the climbing system requires a high degree of prudence and individual responsibility and mutual respect. GK Software SE also expressly points out that the climbing facility is not guarded / supervised by GK Software SE personnel. The stay at and the use of the climbing facility is entirely at the user’s own risk. For minors in particular, the regulation in section 5 of this user agreement applies.

7.1.2. Only individuals with the necessary knowledge and experience of the belay techniques and safety provisions applicable during bouldering and climbing are allowed to use the facilities.

7.2. General user rules

7.2.1. By using the climbing facility, the user confirms that he has the necessary knowledge and experience in climbing and belay techniques and provisions as well as insight into the dangers of climbing. 7.2.2. The max amount of climbers shall not exceed 9 climbers at the same time in the climbing area. The maximal number of persons in the climbing area shall not exceed 20.

7.2.3. It is only allowed to boulder in the explicitly marked areas which are laid out with according soft floor mats

7.2.4. The climbing area or parts of the climbing area might be closed. It is forbidden to enter these closed areas or climb or boulder in them.

7.2.5. Ropes in use shall not be shorter than 40 meter.

7.2.6. Participants shall always expect falling climbing material.

7.2.7. Loose or broken climbing holds, hooks, express slings, carabiners, harnesses, etc. have to be reported immediately.

7.2.8. It is forbidden to play in climbing areas of the climbing facility (Climbing and Bouldering Area) and in those areas where things might fall down. Especially small children and toddlers shall not be in that area.

7.2.9. Artificial climbing holds can out of the sudden become loose or break and therefore might become a danger for and or harm the climbers and belayers. GK Software SE does not accept any liability for the installed climbing holds.

7.3. General climbing rules

7.3.1. Lead climbing (climbing with hooking the rope to the securing equipment from below) is always associated with considerable risk of falls and injuries. For this reason it is in the climber’s own interest to use a certified securing equipment. Every climber and the person securing him/her is responsible for the securing equipment chosen by him/her.

7.3.2. A lead climber has to use all existing intermediate safety hooks to reduce the risk of falling. These cannot be unhooked by other climbers whilst the route is being climbed. It is forbidden to enter an already occupied route. This also applies if a route crossing is already occupied.

7.3.3. Only one rope at a time can be attached to carabiners, especially at the deviation points. This also applies if there is a double carabiner at the deviation point.

7.3.4. A climber can only reverse at the indicated deviation points at the end of each route and not at an intermediate fixing point. If two reversing carabiners are present, both must be hooked in.

7.3.5. When climbing in the toprope (i.e., the rope is solely hooked in the deviation point) or as second climber (i.e., the rope is hooked into all intermediate fixing points), two reversing carabiners must always be used.

7.3.6. The top ropes provided must not be removed and used for lead climbing.

7.3.7. In addition, GK Software SE refers to the knowledge and skills obtained during the "Induction to belaying techniques and climbing facilities".

 

8. Changes, damages and cleanliness

8.1. No food or drinks may be taken or consumed in the entire bouldering and climbing area. Food and drinks may only be consumed outside the climbing area.

8.2. Steps, grips and volume may neither be attached, nor altered or removed by users.

8.3. For hygienic and safety reasons, it is not permitted to climb / boulder barefoot or wearing socks only.

8.4. Stepping onto the fall protection mats in the boulder area is only permitted when wearing climbing shoes, socks or clean sneakers.

8.5. Please ensure that the entire climbing area is kept clean and tidy. All waste products must be disposed of in the intended containers (please pay attention to waste separation).

8.6. Animals are not permitted in the entire area.

8.7. Smoking and any form of open fire is prohibited throughout the area. Outside, cigarette butts must be disposed of in the ashtrays.

 

9. Photo and film recordings

9.1. When taking private photos and making film recordings, the personality rights of third parties (right to their own image) must be observed. The taking of commercial photos and making of commercial film recordings without the permission of GK Software SE is prohibited.

 

10. Notification requirements

10.1. Users are obliged to notify GK Software SE of any damage or accidents occurring during the use of the climbing facility.

 

11. Domestic law

11.1. GK Software SE's domiciliary rights are exercised by GK Software's authorized representatives. Their orders and instructions must be followed.

11.2. GK Software SE is entitled to prohibit the use of the climbing facility and to permanently remove the right to use.

 

12. Limitation of liability by GK Software SE

12.1. The liability of GK Software SE for slight negligent breaches of duty is excluded, as long as they do not affect any contractual obligations, damages from injury to life, body or health or guarantees or claims under the Product Liability Act.

 

13. Privacy Policy

13.1. The personal data of the users collected by GK Software SE are subject to the legal data protection regulations. No personal data will be passed on to third parties.
